These Terms of Service ("Terms") govern your use of the Stop Motion Lab mobile application ("the App") provided by Zerostatic LLC ("we", "our", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App (or 16 years old if you reside in the European Economic Area, the United Kingdom, or Switzerland). If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf and supervise your use of the App.
Subject to your compliance with these Terms, Zerostatic LLC grants you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to download, install, and use the App on devices you own or control for your personal or commercial creative use. Stop Motion Lab is a stop motion animation tool; you may use it to create, edit, and export animation projects. You retain full ownership of all content you create with the App.
The App is available as a free version with optional Pro features available through a one-time in-app purchase. Free version exports include a watermark and are limited to 720p resolution. The Pro upgrade removes the watermark, unlocks 1080p and 4K export resolutions, and enables image sequence export (individual JPEG frames or a ZIP bundle of all frames). Project backup and import are available to all users at no cost.
Pro upgrade purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms and refund policies. The Pro upgrade is a one-time, non-consumable purchase that is tied to your Apple ID or Google account and can be restored on other devices using the same account.
You retain all rights to the animations, photos, audio recordings, and other content you create using the App. We do not claim any ownership or license to your content. Your content is stored locally on your device and is not uploaded to our servers.
You agree not to use the App to create, store, or export any content that:
You are solely responsible for the content you create with the App. We reserve the right to terminate your license to use the App if we become aware of any violation of this section.
The App, including its design, code, graphics, and the Stop Motion Lab name and logo, are the property of Zerostatic LLC and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the App.
The App includes a library of background music tracks sourced from Pixabay under the Pixabay Content License. These tracks are licensed for use within animations created with Stop Motion Lab. You may use them in your exported animations for personal or commercial purposes. You may not extract, redistribute, or sell the music tracks separately.
We may terminate or suspend your right to use the App at any time, without notice, if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will survive.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not guarantee that the App will be error-free, uninterrupted, secure, or compatible with all devices. We are not responsible for any loss of data, including animation projects, frames, or audio recordings.
To the maximum extent permitted by law, Zerostatic LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of the App.
In no event shall our total liability to you for all claims relating to the App exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you paid us for the App in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Zerostatic LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or publicity right, or (d) any content you create, store, or export using the App.
If you downloaded the App from the Apple App Store, the following additional terms apply and supersede any inconsistent provision of these Terms with respect to the App obtained from the Apple App Store:
If you downloaded the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. In the event of any conflict between these Terms and the Google Play Terms of Service with respect to the App obtained from Google Play, the Google Play Terms of Service will control only to the extent necessary to resolve the conflict.
You may not use, export, or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. The App may not be exported or re-exported (a) into any country subject to a U.S. Government embargo, or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Denied Persons List or Entity List. By using the App, you represent and warrant that you are not located in any such country and are not on any such list.
Governing Law. These Terms and any dispute arising out of or related to them or the App will be governed by the laws of the State of Colorado, without regard to its conflict of laws rules.
Informal Resolution. Before filing any formal claim, you agree to first contact us at stopmotionlab@zerostatic.com and attempt to resolve the dispute informally. If we are unable to resolve the dispute within thirty (30) days, either party may proceed to formal resolution as set out below.
Binding Arbitration. You and Zerostatic LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (except for disputes relating to intellectual property, which may be brought in court) will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Boulder County, Colorado or, at your election, by telephone or video conference. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Class Action Waiver. You and Zerostatic LLC agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found to be unenforceable, then the entirety of this Section 16 will be null and void, but the remaining provisions of these Terms will continue to apply.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to stopmotionlab@zerostatic.com within thirty (30) days of first accepting these Terms, stating your name and that you decline arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Boulder County, Colorado, and you and Zerostatic LLC consent to the personal jurisdiction of those courts.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zerostatic LLC regarding the App and supersede any prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice to you, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the updated Terms.
